The Seniors Legal and Support Service provides legal and support services for seniors concerned about or affected by elder abuse, mistreatment or financial exploitation.

Are you eligible for this service?

Our services are targeted towards older people (60 years and over) who are at risk of and/or experiencing elder abuse or financial exploitation, subject to a conflict of interest check.

What does the service provide?

  • Information, advice and support regarding elder abuse, mistreatment or financial exploitation
  • Short-term counselling
  • Information on your legal rights
  • Referral to other legal, consumer and support services
  • Representation for you in court or before tribunals (in certain circumstances)
  • Community education

 

The service does not include preparing wills, advice on real estate, financial or investment planning. If the service is unable to assist you, every effort will be made to refer you to an appropriate service.

Getting ready to talk to TASC

When I call TASC what happens?
  • Reception will complete a conflict of interest check. If a conflict exists, you will be referred to another service
  • Reception will ask a series of questions about yourself and your matter, to complete the Intake process
  • Your enquiry will be forwarded to a Social Worker
  • A Social Worker will call you and discuss your matter
  • Your matter may be resolved at this time. If your matter is more complex the Social Worker will make a one hour appointment with you at this time where you will meet with a Lawyer and a Social Worker
  • Appointments are usually held at TASC but can be made to suit individual needs
How to prepare for your first appointment
  • Think about what your concern is and what you want to see happen with your matter
  • Bring any notes along that will be helpful for you
  • Bring any relevant documentation with you to the appointment
  • You are welcome to bring a support person with you to the appointment

WHO SHOULD CONTACT THE SENIORS LEGAL & SUPPORT SERVICE?
Seniors who are concerned about elder abuse, mistreatment or financial exploitation, or a nominated representative

  • Concerned family members or friends
  • Service providers
WHAT CAN THE SENIORS LEGAL & SUPPORT SERVICE DO FOR YOU?
  • Provide information, advice and support
  • Provide information on your legal rights
  • Refer you to other legal, consumer and support services
  • Try to arrange pro bono legal assistance for more complex legal matters such as recovery of money or property
  • Represent you in court or before tribunals (in certain circumstances)
  • Provide community legal education
HELPING SENIORS TO OVERCOME ELDER ABUSE AND FINANCIAL EXPLOITATION
Elder abuse is any act within a relationship of trust, which results in harm to an older person.

 

It can include:

  • Intentionally hurting a person such as slapping, hitting or mistreating someone
  • Intentionally damaging another person’s property (e.g. hurting pets or breaking belongings)
  • Verbal intimidation, humiliation, harassment or threats of physical harm or abandonment
  • Unwanted sexual or indecent behaviour towards the other person without their consent
  • Preventing a person from seeing others or denying them the right to make their own decisions
  • Intentional or unintentional failure to provide adequate care
WHAT IS MEANT BY FINANCIAL EXPLOITATION?
  • The illegal or improper use, or misappropriation of a person’s property or finances
  • Forced changes to a will and other legal documents
  • Denying someone the right to access and control their personal funds
  • Unfair or fraudulent practices relating to retirement villages, age rental accommodation or residential parks

Relevant information

EPA
  • At your first visit with your lawyer and social worker
  • Lawyer will go through with you what an EPA is. This is an opportunity for you to ask questions
  • You will receive a blank copy of an EPA to take home and review
  • If you wish to proceed completing an EPA, call TASC to book a second appointment. At this time, you will also need to provide the full name and address of who you want as your attorney/s
  • Second appointment with lawyer and social worker. Lawyer will go through the EPA with you again
  • Lawyer will conduct an Assessment to confirm that the EPA can be made
  • If the assessment confirms that the EPA can be made, the EPA is then completed at this appointment
  • On completion of the EPA, you will and yourattorney/s will sign the document
  • The original EPA is given to you at this time
AHD
  • At your first visit with your Lawyer and Social worker, the Lawyer will go through with you what an AHD is. This is an opportunity for you to ask questions
  • You will receive a blank copy of an AHD to take home and review
  • If you wish to proceed completing an AHD, ask your doctor to complete the relevant section
  • Call TASC to book a second appointment
  • Second appointment with lawyer and social worker. Lawyer will go through the AHD with you again
  • On completion of the AHD, you will sign the document
  • The original AHD is given to you at this time
